LAVAUX is committed to protecting your privacy in accordance with the highest consumer protection standards.

LAVAUX Privacy Policy is designed with you in mind, and it is integral that you have a comprehensive understanding of our Personal Information collection and usage practices, as well as full confidence that ultimately, you have control of your Personal Information provided to LAVAUX. For the purposes of this Privacy Policy, “Personal Information” shall mean any information that can be linked to a specific individual including without limitation, information such as name, date of birth, address, phone number, e-mail address and credit card number.

Information collect and Way to use

LAVAUX will not collect or monitor any Personal Information about you without your consent. The only Personal Information we collect is what you tell us about yourself and information when you make Bookings. LAVAUX collects information from you at several different points on our Websites and/or when you make Bookings: Personal Information provided by you are retained for as long as the purposes for which the data was collected continue.

1. New Member Registration

a. What information is collected?

When you register as a member with LAVAUX on our Websites or during the Bookings process, you will be asked to create a login name and password. You always have the right to make subsequent changes on your choice of receiving marketing materials from LAVAUX by sending a written unsubscribe request to LAVAUX International Limited at any time.

b. Why do we collect it?

We collect the above information for the following purposes:

i. To identify you when you use our Websites or when you make Bookings in order to enjoy a customized and personalized experience.

ii. As a security measure, to send you an email confirming your membership registration.

iii. To allow us to process and complete your travel reservations and purchases.

iv. To send you email confirmations for your reservations and purchases on LAVAUX.

v. For our customer service to contact you when necessary.

vi. To send you our optional periodical updates and/or newsletters, if you have signed up for them.

2. Existing Member Profile

a. What information is collected?

After registering as a member with LAVAUX on our Websites or during the Bookings process, you are given the option to create a travel profile with your name and email address and to provide LAVAUX with the following member profile information:

i. Contact information including name, title, email address and phone number.

ii. Ticket delivery information including phone numbers and address details.

iii. Passport information including passport number, nationality.

iv. Date of birth.

b. Why do we collect it?

i. With your member profile stored in LAVAUX, you will enjoy convenience whenever you make travel reservations as you will not have to type the personal and delivery information repeatedly.

ii. To further confirm your identity.

iii. To send you information about products and services which may be of interest to you (unless you indicate to us that you do not wish to receive marketing communications from us including latest updates and promotional materials including discounts and offers from LAVAUX. Please see Section D below for details).

3. LAVAUX Membership Center

a. What information is collected?

i. Any time you make a purchased reservation, on hold reservation or save an itinerary while planning your trip on our Websites, your purchased reservation, on hold reservation or saved itinerary details will be saved into “LAVAUX Membership Center”.

b. Why do we collect it?

i. For your convenience, LAVAUX stores your purchased reservation, on hold reservation or saved itinerary information in “LAVAUX Membership Center”, so that you may easily refer to your trip plans or complete your purchase. You are able to check for your reservations / booking records in “LAVAUX Membership Center – My Bookings”.

ii. To send you information about products and services which may be of interest to you (unless you indicate to us that you do not wish to receive marketing communications from us including latest updates and promotional materials including discounts and offers from LAVAUX. Please see Section D below for details)

4. Customer Contact

a. What information is collected?

i. You may choose to provide feedback to LAVAUX, for example through email or letters. The comments in your feedback, as well as your Personal Information, if provided to LAVAUX, may be kept on record.

b. Why do we collect it?

i. The feedback that you choose to provide is valuable in helping LAVAUX make improvements to our service to you. In order to follow-up on the feedback you have chosen to provide, LAVAUX may correspond with you using the Personal Information that you have provided.

a. What information is collected?

When you visit our Websites as a guest or as a member, a cookie is stored onto your computer. 6. Express Consent To Receive Pre-Recorded And Text Messages

a. What information is collected?

i. When you make Bookings, we will request you to provide us with a contact phone number.

b. Why do we collect it?

i. We will use your phone number in the event that we need to inform you of changes or other matters that may affect your booking or trip, such as changes due to transportation delays, inclement weather, and cancellations. We may give a phone call or use text messages to provide you with such updates. When you provide us with a cellular, wireless, or phone number as the contact number for a trip, you agree that you are providing us with your express consent to receive prerecorded voice messages or text messages related to your booking from LAVAUX or any of our vendors or suppliers. If you do not wish to receive these trip updates on your cellular or phone, please provide us with another phone number.

Use of Data in Direct Marketing

We intend to continue to use your Personal Information collected and held by us for the aforesaid purposes through various communication channels such as direct mail, email or phone for use in direct marketing but we cannot so use your Personal Information without your consent. In this connection, please note that:

i. your name, address, phone number, email address, transaction pattern and behavior and demographic data held by us from time to time may be used by us in direct marketing;

ii. the following classes of services, products and subjects may be marketed:

1. related services and products offered by LAVAUX, its related group of companies and LAVAUX’s co-branding partners (the names of such co-branding partners will be provided during the application of the relevant services and products, as the case may be);

2. reward, loyalty, privileges or co-branding programmes and related services and products; and

3. donations and contributions for charitable and/or non-profit making purposes.

iii. the above services, products and subjects may be provided by:-

1. LAVAUX, its related group of companies, and its co-branding partners;

2. third party services providers;

3. third party reward, loyalty, privileges or co-branding programme providers; and

4. charitable or non-profit making organisations.

iv. In addition to marketing the above products or services, we also intend to provide the data described in paragraph D (i) to LAVAUX, its related group of companies, and the co-branding partners or associates of any of the foregoing for use by them in marketing those products or services but we will require your written consent (which includes an indication of no objection) for that purpose.

Before finalizing a booking on our website, you will be provided with an opportunity to consent or object to the use of your personal information for direct marketing purposes by LAVAUX’s related group companies.

1. LAVAUX is the owner of all the Personal Information collected on our Websites or via the Bookings. We do not sell or rent any Personal Information to third parties.

2. We may disclose your Personal Information on occasion to third parties. Some of these third parties may be located outside your home country. For example, such countries may include, without limitation, Japan, Korea, Singapore, Malaysia, Australia, New Zealand, Hong Kong and Taiwan. The Personal Information will be protected in a manner that is consistent with this Privacy Policy. Disclosure may include without limitation, the following scenarios:

a. To successfully complete your travel reservations or purchases or otherwise implement our terms of service, your Personal Information is provided as needed to third party product and service providers and distributors including without limitation the hotels, travel suppliers, travel insurance agencies or other third parties authorised by LAVAUX, whenever you purchase or reserve travel with LAVAUX.

b. When required by law to disclose the Personal Information.

c. With your prior express consent.

d. To protect the rights and property of LAVAUX.

3. LAVAUX may share your Personal Information with third parties when you engage in certain activities on our Websites that are sponsored by third parties, such as electing to receive information or communications from a third party (such as a hotel company or a tourism board for a particular destination), or electing to participate in promotions, contests, sweepstakes, games or other programs sponsored in whole or in part by a third party. LAVAUX may also share your Personal Information when you respond to promotional materials from LAVAUX and authorize a third party to use your Personal Information for purposes such as, for example, sending you additional promotional materials, providing you a product or service, or entering you in a contest, sweepstakes or game. 5. LAVAUX may also work with third parties that serve advertisements to our Websites and across the Internet on our behalf. Such third parties may (a) collect anonymous information about your visits to our Websites, and your interaction with our products and services, and (b) use information about your visits to our Websites and other websites to target advertisements for goods and services. This anonymous information is collected through the use of web beacons such as but not limited to pixel tags, which is industry standard technology used by most major websites. The web beacons may be used with cookies to compile aggregated statistics to analyze how our Websites are being used and may also be used on some of our emails to let us know which emails and links have been opened by the recipient. This allows us to gauge and monitor the effectiveness of our customer communications, advertisements and marketing campaigns on our Websites and across the Internet. No Personal Information is collected or used in this process.

You should also note that the processing of Personal Information on our Websites and the transmission of transaction messages relating to your travel reservations or purchases or Bookings, including your Personal Information, may involve transmissions over various networks (which may not be secure) and to various countries (including the US) and further processing and storage of data in such countries.

We may also disclose your Personal Information to our related group of companies, affiliates and non-affiliated business partners for their use both on our behalf and for their own business purposes but only with your written consent. For example, our affiliates and business partners may, after obtaining your written consent, use such Personal Information to send you information about their products, services, other information, and materials that may be of interest to you.

Control on your own information!

1. Accessing your Personal Information and retention of Personal Information

a. You may at any time access, delete or change your Personal Information or subscribed services. You can easily access your Personal Information if you login as a member to LAVAUX or you can follow the links that may be provided within our subscription emails to you to manage your subscription preferences. Although we will take reasonable steps to keep your Personal Information accurate, complete and up-to-date, we request that you keep your Personal Information as current as possible so that we may continue to improve our service to you.

b. We will only withhold your access to the Personal Information in limited circumstances where it is permitted by law, such as:

i. where it might be dangerous if you were to have it;

ii. where it might prejudice an investigation currently underway;

iii. where it relates to court proceedings and may be subject to the discovery process;

iv. where it may relate to a commercially sensitive decision-making process; or

v. where other individuals’ Personal Information is contained in the same record.

c. You agree that LAVAUX may retain your Personal Information for a period of seven (7) years from the date you last accessed your account.

2. Minors

As we cannot distinguish the age of persons who access our Websites, a blanket privacy policy is applied. LAVAUX does not seek or intend to seek to receive any Personal Information from minors (i.e. children younger than thirteen years of age). Should a parent or guardian have reason to believe that a minor has provided LAVAUX with Personal Information without their prior consent, please contact us to ensure that the Personal Information is removed and unsubscribe them from any promotional contact opportunities.

a. LAVAUX has implemented technology and security features to safeguard the privacy of your Personal Information. A secure server protects your Personal Information. Additionally you can be assured that the information you provide to LAVAUX is transmitted using Secure Socket Layer (SSL) encryption. If you become aware of any security breach, please let us know as soon as possible.

b. We have internal procedures in place requiring our employees and data processors to respect the confidentiality of any Personal Information held by LAVAUX.

c. LAVAUX will endeavour to take all reasonable steps to keep secure any Personal Information which we hold about you. Your Personal Information is stored on secure servers that are protected in controlled facilities. Unfortunately, despite the aforementioned technology and security features, no data transmission over the Internet can be guaranteed to be 100% secure, so we cannot give an absolute assurance that the Personal Information you provide to us will be secure at all times, and we cannot be responsible for any event arising from unauthorised access to your Personal Information. LAVAUX will not be held responsible for events arising from third parties gaining unauthorized access to your Personal Information.

d. Please note also that LAVAUX may use overseas facilities to process or back up your Personal Information. As a result, we may transfer to and store your Personal Information at our overseas facilities. However, this does not change any of our commitments to safeguard your privacy in accordance with this Privacy Policy.

a. You can play your part in safeguarding your Personal Information by never disclosing your login password or account information to anybody unless such person is duly authorized by you. Whenever you login as a member on LAVAUX, particularly on somebody else’s computer or on public internet terminals, you should always logout at the end of your session. b. LAVAUX cannot be held responsible for lapses in security caused by third party accesses to your Personal Information as a result of your failure to keep your Personal Information private. Notwithstanding the foregoing, you must notify us immediately if there is any unauthorised use of your account by any other internet user or any other breach of security.
